The dangers of alcohol abuse and overconsumption are well known. But given the severity of those risks, and the prevalence of alcohol in our lives, it’s worth thinking about the systems that are in place to prevent one person’s wild night from having a tragic consequence. 

How bartenders, servers and business owners are trained has significant public health implications. A research paper by the California Department of Alcoholic Beverage Control found “statistically significant reductions in single-vehicle nighttime traffic crashes (those with high percentage of alcohol involvement) by the end of 1989, following the implementation of compulsory server training” in Oregon. 

The California study was released in 1992. Unfortunately, in the decades since, the integrity of instructor-led alcohol server certification has been completely lost as this training has largely moved online. Now, the participation of ‘certified’ servers in actual training is completely unknown and unprovable. 

This isn’t to say that online training is bad — there are significant benefits in terms of accessibility and cost savings for participants. But failing to adapt the way we train alcohol servers to this new reality has significantly compromised training outcomes — and put those important public health benefits in jeopardy. 

Online vs. In-Person Training

Pre-internet and, more critically, pre-Covid, most alcohol server training was done in-person, and testing was closely monitored. Successful participants were then issued a certificate that verified they had received the necessary training, and satisfied the required outcomes. 

That proof of training could be used as a legal defense for a business, their insurance company, or their legal counsel, if they were sued under dram shop laws. (Dram shop laws are legislation designed to protect DUI victims seeking compensation after sustaining long-term injury and disability.)

However, as alcohol server training moved online, businesses lost the ability to demonstrate proof of training to the necessary standards. Even verifying the identity of the participant is difficult — let alone whether or not they took the training or the exam under the prescribed conditions. 

In many cases, now, alcohol server certification can be obtained simply by paying for the certificate — there is little oversight, and no process for independently confirming that training was completed.

All of this begs the question — what value is training if it can’t be confirmed? How can businesses mitigate risk, perform due diligence, and avoid liability, while still benefiting from the convenience and cost-savings of online alcohol server training?

The Current Situation 

Today, the choice is not between in-person and online training, but between verified and unverified training. Verified training involves additional checks — remote proctoring and ID verification — to hold online training to the same standards as in-person. 

Unverified training, on the other hand, involves no additional checks. Individuals, or others on their behalf, can simply create an account, pay for the course and obtain a proof of training card. There is nothing in place to confirm that the course was taken, or that there was any validation of knowledge transfer (ie, an exam.) 

We recently tested numerous online responsible alcohol service training providers with a simple criteria: could a dog complete this training? In many cases, yes. A pug has successfully completed online alcohol server training, among dozens of other certifications. If a dog can get certified, what value does this training have to prevent fatalities. or as proof of due diligence in the defense of a lawsuit?

The good news is that some regulators insist on verified training processes. Some businesses, whether they are required to or not, only use online training providers that issue verified training. And some insurance companies are proactively looking at training standards/processes in determining rates. 

The world is changing rapidly, and as we rush to adopt new technologies and new ways of doing things, we can’t forget the reason for doing things in the first place. Alcohol server training isn’t a box you check or a form you fill out — it’s a vital defense against serious injury caused by impaired driving. We believe it can be delivered online without losing its legal or public health value. But organizations need to hold it to a higher standard, and demand and invest in verified training. Regulators must adopt consistent, forward-thinking regulatory standards across the board. Only then can we move forward with confidence, knowing that online alcohol server training is as effective as in-person.

Maintaining food safety across restaurants, processing plants, grocery stores, and other food handling environments is a complex, multi-layered challenge. Workers handle food directly. Managers set policies, define processes, and own the day-to-day culture of operations. Different roles require different training, and the stakes at the management level are particularly high.

When food manager certification programs fall short, the consequences are not abstract. In 2020, Chipotle incurred a $25 million fine because it failed to ensure that employees understood and complied with its food safety protocols. The fine followed a series of foodborne illness outbreaks between 2015 and 2018 that affected more than 1,100 people.

As Assistant Attorney General Jody Hunt stated at the time, the case highlights why it is important for restaurants and members of the food services industry to ensure that managers and employees consistently follow food safety policies.

Training is the first line of defense. And for online food manager certification specifically, there are four areas where most programs fall short.

Background: Food Handler vs. Food Manager Certification

In the US, state-level agencies determine training requirements for food handlers, generally following standards defined by the American National Accreditation Board's Conference for Food Protection Standards, which is based on American National Standards Institute guidelines.

Food safety manager certification applies to managers and team leads, the people responsible for those with food handler certification. It requires a deeper understanding of foodborne illness prevention, HACCP principles, sanitation practices, and regulatory requirements. ANAB/ANSI standards require that food manager certification exams are proctored and that test takers verify their identity before starting.

1. Verification and Proctoring

For certification to be meaningful, the person taking the exam must be who they say they are and must follow the rules throughout the session. ANAB/ANSI standards are explicit about this requirement.

The problem is that many proctoring services claim to check participant IDs without applying any meaningful standard of scrutiny. In many cases, a library card or gym card is accepted without question. When the identity check is that superficial, the system is open to abuse and the certification it produces is vulnerable to challenge.

2. Scheduling

Food service workers often work long, unpredictable hours. Unless proctored certification exams are available on demand, finding time to complete them is genuinely difficult. When workers can find the time, some proctoring systems make them wait, with reported wait times of 45 minutes or longer before a session can begin.

On-demand proctoring that is available at any time, on any device, eliminates this barrier entirely. A food service manager working a split shift should be able to complete a proctored certification exam during their break, not schedule around a proctoring provider's availability.

3. Participant Security and Provider Liability

Most proctoring services require participants to install software, browser plugins, or extensions to enable remote monitoring. This can involve bypassing standard security restrictions, changing system settings, or disabling antivirus software. Participants typically receive no follow-up support, no instructions for re-enabling security features, and no help uninstalling the proctoring software after the exam.

For certifying organizations, this creates practical and legal exposure. Installation requirements increase participant support demands significantly and introduce security risks that the organization then shares responsibility for.

4. Equity

Online proctoring systems that require specific devices, operating systems, or browser configurations create disadvantages for participants who do not have access to the required setup. Food service and related industries are diverse workplaces. A certification system that privileges certain technological configurations over others introduces inequity into a process that is supposed to be objective.

AI-based proctoring compounds this problem. Systems that rely on automated behavioral monitoring without human oversight leave no room for context, nuance, or accommodation. A participant with a disability that affects eye movement could be flagged for a violation they did not commit, with no meaningful review process to catch the error.

Most people assume fraud means stealing or pretending to be someone else. In the world of workplace training and certification, the definition is broader than that. Fraud is also when a person receives credit for something they did not, in fact, do.

That definition has real consequences for employers, and two recent cases make it impossible to ignore.

When Certifications Become Fraudulent

In Australia, a registered training organization was charged with issuing false documents to multiple trainees. The organization marked participants as attending a full two-day training when they had actually left at noon each day. Participants received certifications to operate forklifts and erect scaffolding without meeting the full training requirements. The organization faced significant financial penalties as a result.

In Canada, the Royal Canadian Mounted Police uncovered a large-scale counterfeiting operation selling fake training certifications for safety credentials including H2S Alive and First Aid/CPR. H2S Alive is issued to people working with hydrogen sulphide, a highly flammable and toxic chemical. The people who purchased these certificates did not miss half a course. They did not participate in any training at all.

In both cases, employees and their colleagues were put at risk. That risk includes injury, loss of limb, and death.

Why This Happens More Often Than Organizations Realize

It is far too common for certificates to be issued without confirming identity or full participation. Most people do not think twice about the consequences of leaving a training session early. Few would assume that attending training where identity and attendance are not confirmed could result in a regulator declaring their certificate fraudulent.

But that is exactly what happens.

Employers carry a legal and moral responsibility to protect their employees and their organization from risk. Employee certifications are a promise to colleagues, clients, and regulators that your workforce meets industry standards. If you cannot demonstrate that your employees actually completed the required training, that promise is hollow and the certification that represents it may be worthless.

Without a trusted mechanism to verify identity and participation, the consequences range from reputational damage to financial penalties to legal action.

Who Is at Greatest Risk

Workers who operate heavy machinery or work with dangerous chemicals face the highest physical risk from fraudulent certifications. But employees across all roles must be able to demonstrate proof of training that holds up to scrutiny.

The Australian case resulted in financial penalties and a loss of public trust. For organizations in regulated industries, that combination of reputational and financial damage can have lasting consequences that far exceed the cost of implementing proper verification in the first place.

How Organizations Are Addressing This

The solution starts with how training organizations are selected and evaluated. For in-person training, careful vetting of providers is essential. For online training, which now accounts for the majority of workplace learning, the training organization must use an identity verification and participation monitoring solution.
